All of our products are new, undamaged, and never been used. Most of our products are in stock for fast shipment.


Introduction
The Customer known as Buyer agrees to the terms and conditions outlined in this Online Contract ("Contract") with respect to the goods, services and information provided by or through the www.colemanfurniture.com Site also known as the Company. This Contract constitutes the entire and only agreement between Coleman Furniture and Buyer, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the goods, services and information provided by or through the Site, and the subject matter of this Contract. Buyer review and accept this Contract conditions prior to purchasing anything and purchase of a good or service which binds and should be irrevocably deemed and of total acceptance of this Contract.

Setup and Payment
Buyer represents and warrants that (i) the credit card information supplied is true, correct and complete and (ii) charges incurred by the Buyer will be honored by the Buyer's credit card company and (iii) Buyer shall pay charges incurred by Buyer at the amounts in effect at the time incurred, including all applicable taxes. Buyer shall be responsible for all charges incurred through use of Buyer's password. Buyer agrees to keep his or her password confidential and to notify Company within 24 hours of any breach of this Contract or unauthorized use of the password. Buyer releases Company of any responsibility derived from unauthorized use of Buyer's password.


ORDER ACCEPTANCE
The receipt of an order number does not constitute the acceptance of an order or a confirmation of an offer to sell. Coleman Furniture reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any customer. Verification of information may be required by Company prior to the acceptance of any order.

Copyright
The Customer consent that content, organization, gathering, compilation, magnetic translation, digital conversion and other matters related with electronic Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, redistribution, use or publication by a Buyer of any such content or any part of the Site is prohibited.

Indemnification
Buyer agrees to indemnify, defend and hold Company and its affiliates, licensors and suppliers harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to a Buyer's violation of this Contract or use of the Site.

Non-Transferable
 
Buyer's right to use the Service is not transferable and is subject to any limits established by Company or by Buyer's credit card company.

Disclaimer
THE SERVICE, CONTENT, GOODS AND SERVICES FROM OR THROUGH THE SERVICE ARE PROVIDED "AS-IS," "AS AVAILABLE," AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THE SOLE AND ENTIRE MAXIMUM LIABILITY OF COMPANY, FOR ANY REASON, AND BUYER'S SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE PARTICULAR ITEMS PURCHASED. COMPANY AND ANY OF ITS AFFILIATES, DEALERS OR SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND BUYER. THIS SITE AND GOODS AND SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. SOME STATE STATUTES MAY APPLY REGARDING LIMITATION OF LIABILITY.

CANCELATION POLICY

Once the order has been placed with Coleman Furniture, it is aloud to submit an order directly to the manufacturer in name of customer. Which is done immediately after buyer acceptance to terms of service is received and   a P.O. number has been assigned. Once this is done by Coleman Furniture, customer becomes substantially obligated for payment order, becoming financially obligated for purchase ordered items from the manufacturer. In this regard, Company can not accept cancellations and Buyer clearly understand that once the 24- hour’s window has passed from the time you receive your P.O. Number its payment order becomes a customer payment responsibility. The customer agrees as its responsibility to verify that e-mail receipt information and documentation order details are correct. After a placement order company agrees a waiting time of 24 hours to review Buyer e-mail confirmation and any discrepancies reply or changes at no charge; however if customer does not notify  any changes within the 24-hour window, Coleman Furniture is dully authorized by customer to proceed ordering the merchandise from the manufacturer. Any cancellation of the order after this point will need to follow the Cancellation Policy procedure described as this contract attachment. IF YOU HAVE BEEN ADVISED THAT YOUR ORDER WILL BE EXPEDITED ( IF YOU REQUEST DELIVERY FASTER THAN THE NORMAL 3-4 WEEK DELIVERY TIME), WE CANNOT CANCEL YOUR ORDER ONCE IT IS RECEIVED, EFFECTIVE IMMEDIATLY AFTER ORDER IS PLACED, WE CANNOT CANCEL IT WITHOUT THE 20% RESTOCKING FEE. Exceptions to this matter are exclusive discretion of Coleman Furniture management. In the event that Coleman Furniture management accepts the cancellation, customer is obligated to a cancellation payment or restocking fee of 20% of the purchase price as well as any shipping and handling fees that may apply. For an addressed cancellation consideration, customer must submit a writing request via e-mail within the waiting period of 24 hours previously referred and sent to Sales@Colemanfurniture.com  site with the word “Cancellation” on the subject line. To this matter,  buyer clearly understand that only Coleman Furniture can managed written cancellation requests following previous described procedures made in a waiting 24 hours period after order placement.
Shipping charges are NON- REFUNDABLE.
Orders are subject to Coleman Furniture’s availability to deliver specified merchandise. IF at any time, for any circumstance, Coleman Furniture determines that it is unable to deliver the purchased item, Coleman Furniture, may elect to cancel the order at no charge to the customer or other previously agreed

CHANGE ORDER

Under this contract terms customer agrees that Coleman Furniture is the only allow to make manufacture communication so that customer may not change an order without Coleman Furniture consent. In the event that  customer requests a change Coleman Furniture will determine if the change can be accommodated or not, if so, customer will be solely responsible for all penalties and fees associated with the change.
Customer is solely responsible prior to placement of the order to determine the color wanted, patterns, fabrics, design, dimensions and any other characteristics of all desired items. The customer is also responsible to ensure that all items ordered meet any size limitation imposed by doors, rooms and passageways when delivered.  Due to the infinite variances by computer monitors Coleman Furniture is not responsible for any color representation of any item viewed over the internet.

Right to Refuse
Coleman Furniture reserves the right in its sole discretion to refuse service at any time. Sale of any goods or services which are it total discretion and subject to merchandise availability.
Shipping and Delivery Policy

Coleman Furniture arranges for customer order to ship via the most dependable, quickest and safest way possible. We ship UPS, LTL, as well as privately owned shipping companies specializing in furniture delivery and assembly, and White Glove Delivery upon request. Shipping charges are calculated according to total price of purchase and are reflected in the shopping cart before checkout.
The delivery service will contact the Customer once the items are ready for delivery to schedule a date and time. If the customer misses a delivery appointment, the customer will be responsible for any additional redelivery fees imposed by the delivery service. The delivery service is not permitted to attach any item to the customers home or walls, nor make any modifications to it. Coleman Furniture is not responsible for any damages to the customer home resulting from delivery; the customer shall make any such valid claim directly to the delivery service.

Inspection of Goods

The customer must inspect each item immediately upon delivery. All damage, scratches, chips, tears or soil must be noted on the Bill of Lading (delivery receipt while the delivery service is still present) and reported to Coleman Furniture within 24 hours. Coleman Furniture is not responsible for damages not noted on the Bill of Lading (delivery receipt while the delivery service is still present).  Your signature on the delivery receipt is your acknowledgement that your merchandise is satisfactory and that everything was received in good condition. Because re-delivery is expensive, the customer should not refuse delivery of any undamaged pieces. The Customer is responsible to inspect the furniture for any damages; if these damages are NOT noted on the delivery receipt before the delivery company leaves the customer must file a complaint with the delivery company and NOT with Coleman Furniture.


The responsibility for damages that occur during the shipping process rests with the shipping carrier who is insured. If you are receiving curb-side delivery you must note any damage to the boxes being delivered on the delivery slip at the time you accept the items. For White-Glove delivery, you must ensure that you note all damages when you sign the assembly service slip/ delivery receipt while the delivery service is still present. Coleman Furniture will then work with the carrier to claim the costs and remedy the situation promptly. Coleman Furniture will follow industry standards in solving minor issues pertaining to craftsmanship or damaged from shipping. Full replacement of goods cannot be expected if repairs according to industry standards can be made.If your order has already shipped from the manufactures warehouse, and you want to cancel it will fall under the Cancelation section of this document.


All shipments are shipped via Local Delivery Service, UPS, LTL, or White Glove Delivery upon request. The carrier will call you to schedule a time and date for delivery. Small items such as bar stools, ottomans, end tables, will all be shipped through UPS.
We usually ship right away, but production and delivery times may vary due to different factors. Most of our orders usually ship between 2-4 weeks after we receive your terms of service agreement and you receive an invoice number. If Coleman Furniture is out of stock on the customers items allow 4 to 6 weeks for delivery. This is only an estimate. Coleman Furniture is unable to guarantee delivery times and cannot be held responsible for delays or changes to this schedule.
Once the order has shipped, shipping charges will not be refunded.

Notification of Delivery
The delivery service will contact the Customer once the items are ready for delivery to schedule a date and time. If the customer misses a delivery appointment, the Customer will be responsible for any additional redelivery fees imposed by the delivery service. The Delivery Company will notify the customer in advance of their arrival. Make sure to have someone there to receive and inspect your merchandise.
IF YOU ARE UNABLE TO COORDINATE YOUR SCHEDULE WITHIN 5 BUSINESS DAYS FROM THE TIME THEY CONTACT YOU FOR DELIVERY, STORAGE FEES MAY BE ASSESSED AND YOU WILL BE RESPONSIBLE FOR ANY AND ALL CHARGES THAT APPLY.
If your order ships via Trucking Company, you will receive the carrier's website or telephone number and the PRO Number via email. You can check the status of your shipment by using the PRO Number online or calling the freight terminal.
In the case that items arrive damaged, see Inspection of Goods section of this document.

PRODUCTS AND PRICING
Prices shown for items on this website's product pages and in your shopping cart are for merchandise only. Proceed to checkout to see the total cost of your order, including any applicable tax, delivery or other fees.

While we strive for accuracy in our pricing and in description of the product and their colors and the other product information provided, errors can occur. Prices and Products displayed may be out of stock or discontinued and the prices are subject to change. In cases where such errors do occur, we expressly reserve the right not to honor offers made on this website or when accepting an order online. In the case that an order placed online is not accepted, any payments that have been authorized for that order will immediately be reversed.

Prices are subject to applicable taxes which are to be paid by the customer. Coleman Furniture charges sales tax on orders based on the destination of the order, in accordance with state and local tax laws. Items shipped to destinations in the State of Texas are subject to applicable State and Local Sales Taxes. Prices are subject to shipping, delivery and handling charges.

Editing, Deleting, and Modification
Coleman Furniture reserves the right in its sole discretion to edit or delete any information or content appearing on the Site or monitoring electronic advertisement and to remove any goods and services for sale. Upon notice published over the Service, Coleman Furniture may modify this Contract, or prices, and may discontinue or revise any or all aspects of the Site in its sole discretion and without prior notice. Modification of this Contract will be deemed effective upon publication on the Site with respect to transactions occurring after said date.

Return and Refund Policy

All refunds and credits will be promptly processed and issued within two weeks. In the event the customer has to return the items purchased, Coleman Furniture will not process the credit until the items are received and inspected. All products being returned must be in new and unused condition, packed in original packaging including any accessories, manuals, documentation and registration that shipped with the product.  Note that Coleman Furniture does not permit the return of or offer refunds for non factory damages or damages that are not caused by the shipment of items and that are not noted on the delivery receipt at time of delivery.
All items being returned must be sent to our Warehouse and Distribution Center located in New York. It is the customer’s responsibility to ensure that the items are prepared for shipping (wrapped, packaged etc.) with care and effort to prevent in-transit damages. The method of shipment will be at the discretion of Coleman Furniture management and will be assessed on a case by case basis. In certain instances we will ask the customer to coordinate the shipment back to our warehouse. However, in some cases Coleman Furniture will coordinate the pickup and shipment of the items. Note that all shipping and handling charges are non-refundable. In the event that Coleman Furniture receives damaged merchandise and the customer coordinates the shipment of these item(s) to our warehouse, the customer becomes responsible for the damages. You may exchange the items you have ordered or request a refund for the purchase price. All shipping and handling costs are non-refundable. The return or exchange of such items will result in shipping and handling costs that will be the customer’s responsibility. In certain cases additional restocking fees may apply and will be deducted at the time the return is processed. Items that are unopened and are in original packaging can be exchanged or returned for a refund based on the original method of payment. All products being returned must be in new and unused condition, packed in original packaging including any accessories, manuals, packing materials, documentation, and registration that shipped with the product. Any exceptions may result in additional fees for which the customer will be responsible. Coleman Furniture is not responsible for the shipping and handling charges of any returned items. All return shipping and handling charges are the responsibility of the consumer.
Some items unfortunately do get damaged during the shipping and manufacturing processes. In order to address any issues promptly you must take the time to inspect the merchandise you have ordered upon receipt. Your signature is your acknowledgement that your merchandise is satisfactory and in order.  If merchandise is signed for as “received in good condition”, any and all damages found after that time will be the responsibility of the customer to take care of.  The customer understands that damages not noted on delivery receipt this will not be grounds for disputing any credit card charges.  There will be no exceptions to this policy.

Warranties

Coleman Furniture will honor the terms of the warranty provided by the manufacturer to the original Customer for a period of one year from the date of factory shipment. Coleman Furniture will try to assist the customer, when possible, in making any warranty repair claims. Defects caused by abuse, negligence or damage from moving are not covered. This warranty provides you with legal rights, and you may have other rights, which vary from state to state.
Coleman Furniture is not responsible for color and grain variations in wood, leather, stone, marble, granite and other natural products. Certain inconsistencies should be expected and add to the character of the merchandise. Imperfections or variations in the grain, color, or sheen of the wood may occur naturally. Stone finishes such as marble and granite may differ in color and veining. Coleman Furniture not responsible for dye lot variations and cannot guarantee exact matches between similar items. Coleman Furniture is not responsible for warranty claims denied by the manufacturer.
